TEAMLAB TERMS OF SERVICE

In this Terms of Service, 'us' 'we' or 'our' means [TeamLab Pty Ltd] (ABN 16 670 421 842). ‘You’, ‘Your’ refers to the client/customer.

You acknowledge and understand that TeamLab is the supplier and organiser for your event and we may employ the use of third-party suppliers and contractors.

The term “services” is to be understood in its widest meaning and incorporates any activity provided for you by TeamLab.

TeamLab reserves the right to amend this document at any time and without prior notice.
Quotations

Quotations are valid for 30 calendar days from date of issue.
Event Pricing
Event pricing is based on two factors:

Event Fee - This is based on the expected number of participants you provide us and will be for up to a set number of participants.

Per Person Fee - This is the amount charged per person after you exceed the number of participants included in the Event Fee.
Confirming Your Event

A payment of 30% of the Event Fee is required to confirm your booking.

If your Event is within 7 days, full payment will be required.

You have the option to pay in full at anytime prior to the Event.

Following your payment, your event date/s and time/s are confirmed.

We will invoice you for the balance owing upon delivery, inclusive of any additional participants, and will be due within 7 days.
Cancellations
We may engage third party contractors and suppliers and are bound by minimum terms with these entities. We therefore incur charges for events cancelled within particular time frames. Due to this, we must institute a cancellation policy. You must communicate your request to cancel an event as soon as possible either in writing to TeamLab or via telephone call (not SMS). You can do so by emailing info@teamlab.com.au or phoning 0411 630 197.
Cancellation Fees
TeamLab understands that the unexpected can happen and you may need to reschedule or cancel a booking.
We ask that you recognise that once a booking is made, we act on it immediately. This includes scheduling our staff, preparing all equipment and materials, blocking out our availability calendar, and making preparations so your event runs smoothly.
For these reasons, our Cancellation Policy applies to all confirmed bookings for our Activities, Workshops and Self-Guided Scavenger Hunts.
Rescheduling
You can choose to reschedule your planned Activity or Workshop to a future date that is mutually convenient, without losing your deposit, or payment.

Reschedules requested within 5 business days of your Event may incur a fee.

You must communicate your request to reschedule an event, and discuss an alternate date, as soon as possible either in writing to TeamLab or via telephone call (not SMS). You can do so by emailing info@teamlab.com.au or phoning 0411 630 197.

If an alternate date cannot be confirmed at time of rescheduling, we will provide you with a credit of the amount paid. The credit must be used within 6 months from date of issue.
Cancellation Fees if you paid in full
If you paid in full for an Activity or Workshop, and choose to cancel, we will retain or refund the following:

0-7 calendar days prior to the scheduled Activity or Workshop, we will retain 30% of the full payment, less any booking fees.

8-14 calendar days prior to the scheduled Activity or Workshop, we will retain 15% of the full payment, less any booking fees.
-
15 or more calendar days prior to the scheduled Activity or Workshop, we will refund your payment less any booking fees.
Cancellation Fees if you paid a deposit
If you have paid a deposit for an Activity or Workshop, and choose to cancel, we will retain or refund the following:

0-7 calendar days prior to the scheduled Activity or Workshop, we will retain 100% of your deposit.

8-14 calendar days prior to the scheduled Activity or Workshop, we will retain 50% of your deposit.

15 or more calendar days prior to the scheduled Activity or Workshop, we will refund 100% of your deposit.
Self-Guided Scavenger Hunt
The exception to the above is our standard self-guided Scavenger Hunts. The link for your Scavenger Hunt is valid for 6 months after date of purchase. As they are self-guided you can choose to complete your Scavenger Hunt at any time convenient to you within 6 months. A refund will not be available.
For a customised self-guided Scavenger Hunt, we will retain 100% of the deposit if the Hunt is cancelled prior to going ‘active’. Once a Hunt is active, no refunds are available.
Decrease in Participant Numbers

We offer full refunds for any bookings cancelled outside of the cancellation periods as listed in this terms of service “Cancellation Fees”.

A reduction in numbers may result in a reduction of the cost of your event, we are unable to make a reduction in your cost if numbers are reduced within 7 days of your event due to our staffing and resource costs.

TeamLab unable to offer refunds for participants who do not attend (‘no shows’) or a decrease in participant numbers on the day of your event.
Start Time Policy
TeamLab aims to deliver the best experience possible within the times you have booked. In order to provide the best experience, we ask that all participants be at the start location 10 minutes prior to the start time. This is so you can be ready to kick-off at the start time.
Should you arrive after the scheduled start time, we will start when you are ready and maintain the scheduled end time. TeamLab is not able to extend the finish time due to a late start.
If participants are late arriving, you have the option to wait for their arrival prior to starting. TeamLab is not able to extend the finish time to accommodate late starts or late arrivals.
Inclement Weather

TeamLab aims to deliver all events as scheduled. Unfortunately, the unpredictability of the weather may impact on your event. TeamLab will monitor the weather within the week prior to your event. We will discuss any concerns with you.

In general:

If less than 2mm of rain is predicted, your event will go ahead.

If the temperature is predicted to be below 35ºc, we will go ahead.
-
If lightning is present or predicted, the activity will not go ahead.
-

All routes have been devised to include stops that provide shelter from rain or sun.
-
Final decisions around inclement weather will be yours and, with 3-days’ notice we can discuss rescheduling your event to another date with no cost penalty.

Alternatively, we can run one of our indoor events should a venue be available at short notice. Venue hire charges will be additional.
Liability and Indemnity

TeamLab are covered by a $20,000,000 Public Liability Insurance policy that covers all participants for any injury or damage caused while participating in our events in the way that we have stated them to be participated in.

To the extent permitted by law, TeamLab (inclusive of subcontractors/agents/third parties) will not be held liable for indirect, special, or incidental, punitive, exemplary or consequential loss, costs, expenses and damages (inclusive of the loss of data, profits, or opportunity whether direct or indirect) incurred or suffered by you in connection with your event. This is regardless of contract breaches, tort (incl. negligence) or warranty, under statute, or any other basis of liability.

While our events are not very physical, we recommend that anyone concerned about a pre-existing medical condition or general fitness level to consult with their health professional prior to participating in our events.

In the event that a claim is to be made, TeamLab ensures to take reasonable actions within reasonable time frames to comply with your requests and that of the insurer.
Access
TeamLab values the diversity of our community. If any of your team members have additional requirements that require accommodating, please give us a call to discuss those requirements. We have attempted to ensure all of our events are physically accessible, but unfortunately some parts of our community are not fully accessible. Contact us and we will ensure that our program is accommodating to the needs of your staff.

Intellectual Property (IP)

You agree that any media, including photographs and videos while on the event, and for the purpose of the event, is to remain the property of TeamLab. Limited personal use permission is granted to you by TeamLab to view/listen to the media for personal, non-commercial purposes only.

Permission must be requested to reuse, reproduce, publish, broadcast or distribute this content on any commercial or public medium, including social media.

Any media containing sensitive information, including but not limited to clues and instructions, and solutions to challenges, must not be published, retained or shared under any circumstances.

TeamLab will take photos and videos during all events to share with you via a Google Photo link after the event. We will seek permission to use any photos or videos taken by TeamLab staff or participants. Such images may be used on our website, promotional material, social media pages, or to promote our services. In no instance will individual participant names be linked to any images, unless permission is granted by you.

We will seek permission by sending a Talent Release Form to the contact person at least one week prior to the event to approve and sign on behalf of all participants. We will also discuss this at the event briefing and give participants the option to decline to have their photo used, but not taken, by TeamLab.

If a participant does not wish to have their photo / image used, please advise us at the time of booking or when the event commences. In this instance, the photo challenges will continue with all images shared to the organisational contact and deleted from TeamLab’s system.

TeamLab is not responsible for any images taken by other participants, using their personal devices, on the event / activity, or how they are used.
Risk Assessment
All events run by TeamLab are risk assessed. Should an incident or accident occur while on one of our events, the facilitator will be advised immediately and first aid performed. To ensure the health and safety of you, we may call an ambulance and any costs associated with ambulance transport will be incurred by you.
Post Event Venues
TeamLab will not be responsible for booking a venue for the finishing point of the event. We may provide you with a range of options in the vicinity of the finishing point.
We ask you to please confirm the booked finishing venue with us as soon as possible, to ensure we can provide our facilitators with this information.
Force Majeure
TeamLab will not be held liable under any circumstances in the event of force majeure, which includes but is not limited to acts of God, government actions, transport malfunctions, war, riots, public action, and the like that is outside the reasonable control of TeamLab.
General

These terms of service constitute the entire agreement between you and TeamLab and replaces any previous version of these terms in respect to your event.

You acknowledge that failure, on our part, to exercise or enforce any right or provision within in this document does not in any way relinquish or waiver the right of TeamLab stipulated within this document and any provisions remain in full force and effect.

Your obligations may not be assigned under these terms without written approval from TeamLab. Amendments to these terms from TeamLab, however, is at our sole discretion and may be made without prior notice.
